Did You Move or Buy Real Estate?

Updated: 2 days ago

If you’ve recently moved, you probably don’t need to re-do your estate plan. unless the move was part of some other major event, like a marriage or divorce, a death, or moving across state lines.

BUT: if you purchased a home – whether a new residence, a vacation place, or investment real estate, then you need to record a Transfer on Death Designation Affidavit (TODDA).

If your married and you bought the property in both your names, chances are the title agency already set the property to transfer to the surviving spouse. However, a TODDA makes sure that upon death, ownership transfers without probate, it is completed after you pass with just a copy of a death certificate and something signed by the person you designated.

Preparing this document requires some advanced knowledge about deed records, something our experienced staff does quickly and efficiently every day. It also requires the correct legal document to comply with the statutory requirements. Once it’s signed and notarized like an affidavit, we’ll take care of having it recorded with your deed, and that’s it!

Contact our office for a brief telephone conversation today about making sure your real estate is set to go with a TODDA.
